Was Your Genworth Life Insurance Claim Denied?
Gianelli & Morris is Ready to Help
Big life insurance companies like Genworth make their money by selling insurance products and collecting premiums. They do not make their money by paying out on claims. Make no mistake: When you file a claim with Genworth or another life insurance company, the claims adjuster’s job is to find any reason they can to deny your claim. There may be legitimate reasons to deny a claim, but in many cases, the reasons are based on a stretched reading of the policy language, a misinterpretation of the evidence on the ground, or are entirely fabricated.
Genworth and other insurers owe you, the customer, a duty of good faith and fair dealing. At Gianelli & Morris, we hold them to their duty. We do not let life insurers get away with denying coverage for unjustified or unlawful reasons. If you have had a life insurance claim denied by Genworth, you do not have to take that rejection sitting down. Call a seasoned life insurance denial lawyer at Gianelli & Morris for advice and representation. We’ll comb through your policy and the reasons offered for your claim denial, and we’ll figure out whether your denial was legitimate. We fight for the rights of our clients to get the benefits they are owed.
Who is Genworth?
Genworth Life Insurance Company is a subsidiary of Genworth Financial. Genworth Financial is an S&P 400 insurance company and has been around in one form or another for over a century, originally founded as the Life Insurance Company of Virginia. Genworth is one of the largest insurance providers in the country. As of 2014, Genworth Life and Annuity Insurance Company and Genworth Life Insurance Company had over $700 billion in insurance policies currently in force. As of 2016, Genworth no longer sells new life insurance policies or annuities, and existing policies have been placed into runoff.
Common Justifications for Denying a Life Insurance Claim
Life insurance companies have an obligation to explain to you exactly why your claim was denied. If they haven’t given you a proper explanation in writing, they have violated the law. Even if they’ve given you a reason, that does not make their justification correct.
At Gianelli & Morris, we’re familiar with the tactics employed by Genworth and other life insurance companies in California. We know the arguments they make, and we know how to fight back. Some of the most common justifications we see for life insurance claim denial include:
- Policy lapse due to missed premiums
- Policy rescission based on misstatements in the original application
- Lack of evidence in the record to support the claim
- Excluded cause of death, such as suicide, pre-existing condition, or criminal conduct
For each of these stated justifications, there’s a counter-argument. Insurers must give proper notice before letting a policy lapse. Policy rescission is only allowed within two years of the policy start date, and only for specific reasons. An excluded cause of death only counts when it is objectively supported by the evidence in the record. Life insurance companies know that beneficiaries don’t know insurance policies and they don’t know the law, and will often take a claim denial as the gospel truth. Do not give up on your benefits just because Genworth says your claim does not count.
Getting the benefits you are owed may be as simple as adding more evidence to the record (autopsy report, police report, etc.) Alternatively, you may need to go through the whole appeals process and, ultimately, pursue a civil lawsuit in court. Whatever it takes to get your legitimate life insurance claim paid, Gianelli & Morris is ready to go to bat for you.
